A new Small Business Owner pathway for ACT is now live

From July 2021, ACT has a new Small Business Owners (SBO) pathway for the 190 and 491 visas. To be eligible for this new pathway, in addition to the usual 190 or 491 critieria, below are the main SBO criteria you must satisfy:

  • You are the majority owner of an eligible registered business located in the ACT and you are claiming Matrix points in the Small Business Owner category
  • The following business types are not eligible: sub tenancy, ride-share, taxi, delivery, courier services or an on-sold business previously used to qualify for ACT nomination
  • Your nominated occupation does not have to be on the ACT Critical Skills List
  • You must be able to claim Canberra Matrix points in the Small Business Owner Category (this is a newly added section)
    • You must be the majority owner (at least 51%) of a registered business actively operating in the ACT
    • The business activity must be located in the ACT
    • Your business must have a minimum turnover of AUD200,000 per annum (or pro-rata)
    • Your business must be profitable
    • Your business must be paying you the following taxable income immediately before date of Matrix submission (for 190: at least AUD26,000 for 6 months, for 491: at least AUD13,000 for 3 months)
    • You must employ at least one Australian citizen, permanent resident or New Zealand citizen for at least 13 weeks (minimum 20 hrs pw)
  • You must sign a statutory declaration confirming the details of your ACT Small Business activity
